The following are some of our recent verdicts and settlements. All of the cases listed, as well as many others, were reported in the New York Jury Verdict Reporter
*** Among the "highest" in the state for their respective years
- *** $30,300,000.00 - James McCrorie was one of three attorneys who attained this verdict for five individuals injured in a devastating automobile accident. The verdict was listed in the annual "Book of Lists" published by the New York Law Journal in March 2006 as the second highest verdict in the State of New York for 2005. The combined offer for all clients was under $1,000,000.00 prior to the verdict.
- $14,000,000.00 settlement attained with co-counsel for a 43 year old married father of three who was paralyzed from the waist down when injured at a major department store due to negligence in failing to follow their own safety guidelines.
- *** $8,400,000.00 verdict for a 27 year old construction worker who severely injured his back when he fell from a ladder approximately 20 feet. The client had several surgeries. The jury found that this young client would never be able to return to work again and awarded him his lost wages and medical costs for life - in addition to his pain and suffering. This verdict was the second largest verdict in New York State for a construction accident in 2002.
- $5,500,000.00 verdict for a 31 year old musician who was injured when the tour van he was traveling in was struck in the rear by a tractor trailer. The client sustained a severe knee injury requiring surgery, along with facial scars caused when he was ejected from his vehicle. He is luckily able to still pursue his chosen career path.
- $3,500,000.00 verdict for wrongful death of a school custodian who fell down an elevator shaft due to improper training and procedures in place at a New York City school. The elevator had also been in disrepair for some time before the accident.
- $2,800,000.00 verdict for a 47 year truck driver who severely injured his neck when he was struck head on by a car that was cut off by a commercial truck making a delivery.
- $2,700,000.00 settlement achieved for the surviving spouse and two adult children for the wrongful death of a 48 year old man who was tragically killed in an commercial airplane crash.
- $1,800,000.00 settlement for a 45 year old construction worker who injured his back after tripping on exposed wire at his work site. He was in the process of erecting a high rise building in Manhattan when the accident occurred.
- $1,750,000.00 jury verdict for a 62 year old woman and her 84 year old friend who were injured in a car accident on their way to church. They were struck by an employee of a major rental car company who was speeding to get a vehicle to another rental location. The 62 year old woman received
$1,200,000.00 for a fracture pelvis and collarbone and the 84 year old woman received $550,000.00 for a fractured vertebra.
- $1,750,000.00 settlement for a 39 year old construction worker injured at a worksite when the ladder he was working upon fell after unexplainably shifting. The responsible party never informed the client that the dock he was working upon would hydraulically lower periodically. The client sustained extensive back and knee injuries.
- $1,700,000.00 settlement for a 46 year old truck driver who was injured when a tractor trailer hooked onto the back of his vehicle while making a left turn and dragged him into a third vehicle. The client sustained a neck injury which was eventually operated on 18 months later.
- $1,400,000.00 verdict for a 49 year old woman who severely injured her neck in a major department store while shopping. The accident occurred when a folding chair fell from a higher shelf of the display she was attempting to remove a chair from. The jury found that the store negligently stacked and displayed the item. The jury also found that the client would never be able to return to work as a teacher and awarded her lost wages and medical costs for life - in addition to her pain and suffering.
- $1,375,000.00 settlement one week before trial for a 48 year old man who injured his neck and back when he was hit in the rear by a truck while stopped at a red light. The client was forced to go on disability from work as a result of the accident.
- $1,350,000.00 settlement for a 32 year old woman who sustained severe neck injuries after her car was struck by a school bus while stopped in traffic. Although able to work for two years after the accident, she was unfortunately forced to leave her employment when her conservative treatment failed and surgery was performed to remove the damaged discs in her neck.
- $1,250,000.00 settlement (insurance policy limits) for a 22 year old man who sustained severe head injuries as a passenger in a car being driven by a friend of his. At the time of the accident, his friend was intoxicated. The young man has made incredible strides in his recovery and has hopes to return to work.
- $1,250,000.00 settlement during trial for a 19 year old man injured in a car accident (insurance policy was $1,300,000.00). The client was a passenger in his girlfriend's car when they were broad sided by another vehicle that was speeding. He required surgery to his back for a herniated disc.
- $1,200,000.00 settlement after liability verdict for two 55 year old women who sutained knee injuries when a bus ran a red light and struck their car. The defendants denied running the light but settled after the jury found otherwise.
- $1,077,000.00 verdict for a 17 year old woman who slipped and fell at a major supermarket chain while shopping with her mother. The store failed to utilize caution signs in the area where an employee had previously mopped. The client required surgery to her knee and will require future medical treatment.
- $1,000,000.00 settlement during trial for a 33 year old school bus attendant who injured her right ankle while helping children off the bus in front of a school. The young woman twisted her ankle on a broken sidewalk curb and eventually developed a severe pain syndrome that prevented her from working.
- $1,000,000.00 settlement (insurance policy limits) during trial for a 22 year old man who was a pedestrian struck by a security vehicle as he attempted to cross a highway within a crosswalk. Although crossing against a red light, the jury believed him when he testified that the he was stopped within a marked shoulder at the time of the accident waiting for the defendant to pass. He sustained a significant head injury and severe leg fracture.
- $980,000.00 combined verdict for a mother and daughter injured in a car accident. This 32 year old mother sustained injuries to her back and settled for $150,000.00 at trial. Her 7 year old daughter was awarded more than $730,000.00 for a five inch scar to her forehead. The payout to the daughter was worth approximately $1,500,00.00 as it will be paid over time until she reaches adulthood.
- $950,000.00 verdict for a 46 year old woman who broke her foot in several places after being struck by a falling light pole that was struck by a tractor trailer. The jury found that the client would require follow up medical care for life. $900,000.00 verdict for a 47 year old man who fell due to inadequate lighting at an apartment building while in the course of his employment. The client injured his left knee and required two surgeries.
- $750,000.00 pre-trial settlement for a 39 year old construction worker injured when his scaffold tipped over due to the negligence of other contractors on the job.
- $725,000.00 settlement during trial for a 45 year old women who sustained injuries to both knees in a car accident requiring arthroscopy surgery.
- $605,000.00 verdict for a 76 year old woman who fractured her leg after receiving an electric shock at a convenience store after brushing up against a refrigerator. The jury found that the refrigerator was not properly grounded and caused the accident.
- $600,000.00 settlement for a 28 year old woman who slipped and fell in a fast food restaurant after an employee mopped in the counter area without her knowledge. She sustained knee and back injuries and was forced to leave her new job as a result of medical complications.
- $525,000.00 settlement during trial for a 70 year old man who slipped and fell in a supermarket on a wet ramp at the entrance fracturing his right hip.
- $500,000.00 settlement during trial for a 43 year old construction worker who fractured his left knee when a scaffold that he was working on collapsed. The firm also obtained lifetime social security disability benefits for the client.
